Terms of Service

These Terms of Service ("Terms") govern your access to and use of the getSteve website (the "Site") and any related services (collectively, the "Services") provided by getSteve, Inc. ("getSteve," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Definitions

• "User Content" means any data, text, audio, video, images, or other materials you submit through the Services.
• "Third-Party Services" means any products, services, or content provided or operated by parties other than getSteve.
• "Purchases" refers to any paid transactions you complete through the Site.

2. Eligibility & Account Registration

1. You must be at least 16 years old to use the Services.
2. By creating an account, you represent and warrant that all information you provide is accurate and complete.
3. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Modification of Terms

We may update these Terms at any time. If we make material changes, we will notify you via email or via a notice on the Site. Your continued use of the Services after the effective date of any revision constitutes your acceptance of the updated Terms.

4. Services & Use Restrictions

1. License Grant. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal purposes.
2. Prohibited Conduct. You agree not to:
   • Reverse engineer, decompile, or disassemble any portion of the Services;
   • Circumvent security measures or attempt unauthorized access;
   • Use the Services to infringe intellectual property rights or violate applicable laws;
   • Upload viruses or other malicious code;
   • Use data-scraping tools, bots, or automated methods to extract data;
   • Impersonate another person or entity.

5. User Content

1. You retain ownership of any User Content you submit.
2. By submitting User Content, you grant getSteve a perpetual, worldwide, royalty-free, sublicensable right to use, reproduce, modify, publish, and distribute that content in connection with operating and improving the Services.
3. You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third-party rights.

6. Purchases & Billing

1. All fees are billed in U.S. dollars and are non-refundable unless otherwise stated.
2. By making a Purchase, you authorize us (or our payment processor) to charge your chosen payment method.
3. You are responsible for paying any taxes associated with your Purchases.

7. Third-Party Services & Links

1. The Services may integrate with or link to Third-Party Services (e.g., Google Cloud, analytics providers, payment processors). Your use of those services is governed by the third parties’ terms and privacy policies.
2. We do not endorse and are not responsible for those services or the content they provide.

8. Privacy & Cookies

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and disclose information (including cookies, transcripts, video-analysis data, and Purchases) and your rights under applicable law.

9. Disclaimers & Warranty

1. THE SERVICES ARE PROVIDED “AS-IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.
2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, getSTEVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

1. IN NO EVENT WILL getSTEVE OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
2. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO getSTEVE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless getSTEVE and its officers, directors, employees, and agents from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your violation of any law or third-party right.

12. Termination

1. We may suspend or terminate your access to the Services at any time, with or without cause, and without prior notice.
2. Upon termination, your right to use the Services will immediately cease, and we may delete your User Content in accordance with our Data Retention policy.

13. Governing Law & Dispute Resolution

1. These Terms and any dispute arising out of or related to them will be governed by the laws of the State of California, without regard to its conflicts-of-law principles.
2. You agree to submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, and waive any objection to venue or inconvenient forum.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements you enter into in connection with the Services, constitute the entire agreement between you and getSTEVE regarding the Services and supersede all prior or contemporaneous communications.
